European standards of constitutional rights, human and civic freedom limitation

Abstract

The research studies the theoretical issues ofhuman and civil rights and freedoms. Different types of human rights are distinguished depending on the nature of freedom. The author analyses methods, forms and constitutional criteria of human and civil rights. The constitutional criteria for the implementation of human rights restrictions that are inherent in the national Basic Law and the constitutions of the EU member states are investigated. The article provides features, peculiarities and types of human and civil rights and freedoms limitation in Ukraine and the European Union member states. The legal grounds for limiting the rights and freedoms of man and citizen are determined by the relevant international documents of a universal or regional character. The author suggests a classification of constitutional limitations of human and civil rights and freedoms. A research draws conclusions which include some topical issues and give grounds for further scientific discussion regarding the human and civil rights and freedoms limitations in terms of current state-building process.
